Can I file papers for my husband if my husband came in with a tourist visa but got sent back for 5 years?

He came to USA with a tourist visa but he worked while being here . He has been in Mexico for about 2 years but they gave him 5 years . Will it help him if I file his papers ? Or will the process be longer?

A US citizen spouse can sponsor a foreign national spouse for a green card, but if the foreign national spouse is found to be inadmissible based upon an immigration violation, then you would need to file a waiver of that inadmissibility in order for him to qualify for a green card.
