Hi..!! I got a students visa in October 2015 with a validity for 5 years. I came to the USA in Dec 2015. I realised that the commitments given by the college were not correct to a good extent, and since I didn't want to indulge into a college hopping practice, I came back to India in January 2016. Family issue was also an added reason. I am a working professional and do not intend to pursue higher studies now. Can I apply for a visitors visa now? Or will it get rejected since I got the students visa but didn't study in the USA?
You may be able to apply for a visitors visa now and have it approved although, as you are aware, the granting or denial of such visas is in the discretion of the American consular officer. From your fact situation, it does not appear that you did much wrong. You applied and received a student visa, came to the US, immediately realized that something was wrong and that you did not fit within the student program of the school, and immediately left the country. You also appear to have good ties to your home country such as family and job. No one can ever guarantee that someone will or will not obtain a visitor's visa, but you should perhaps try.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
