QUESTION

Can I get deported if I get an ACD or YO? Should I plead guilty or not guilty?

Asked on Jan 01st, 2013 on Immigration - New York
More details to this question:
I was recently charged with petit larceny after stealing $368 dollars worth of merchandise from Sephora (I know I'm an idiot). The LP took me to the back of the store and let me know that if it were up to him he would let me go since I was so well behaved but unfortunately his boss wants the police to be involved because of the items price. This is my first offense, I'm a senior in high school who has been involved in strenuous extra curricular activities (have leadership positions in four of them), I have good grades and am also a perminant resident. My first appearance is in a couple of days and i already got a public defender. Will this affect my chances to renew my green card in September (that's when it expires)?

Neither an ACD "Adjournment in Contemplation of Dismissal " nor YO "Youthful Offender classification is deemed to be a conviction for immigration purposes and so, neither disposition is likely to result in your deportation. But you must know that becoming a legal resident of the US is a privilege you must never abuse by getting into trouble

I know you may not want to hear this but your family should pay for a consultation with an experienced Immigration Attorney to review all aspects of your case. Any arrest may pose serious immigration consequences. The money spent may be well worth the investment, but do it BEFORE it is too late. I am in New York but also do telephone consultations as do many others of us. Good luck.
