Can I get my money back?

More details to this question:
I have an issue with my attorney. She has been telling me for 9 months that she sent my paperwork to the uscis, but as I found out it wasn't true. According to uscis customer service representative(I called them many times) they never got anything. Every time the lawyer would tell me that she will fix it and that I have to wait. But I haven't received any receipts or action of notice from the government for 9 months! I am married to a us citizen. All the attorney fees were payed off up front as well as the amount that she needed for uscis fees. Can I get my money back? What are my options? Should I talk to the state bar?

You may be able to get your money refunded if no work was done. You coukd contact the attorney directly and request a return of your money including the government filing fees. You could also file a lawsuit against her. Depending upon the amount involved, you may be able to file a small claims action. You may also want to contact the state bar association. There may be an arbitration process available regarding attorney's fees. New York offers such a program and many people take advantage of it as there are less procedural hurdles involved.
