Can I make an asylum claim?

More details to this question:
I am currently in deportation proceedings. I was arrested for CDV 1 , the judge said it will be dismissed in 90 days. However my husband is a disabled US citizen and I have three US citizen children. He receives SSD but it isn't enough to sponsor me. I got a cosponsor but he had cosponsored my brother four years ago. What should I do in a situation like this. I cannot fine another cosponsor at this moment. Can I make an asylum claim? I have been in the US for 16 years and my visa is expired. What can I do to stay with my family.

The chances for asylum depend upon many factors. Don't face deportation proceedings alone.

If you have real fear of going back, you may apply for asylum and/or withholding of removal. But you should consult with an immigration attorney.

There may be a variety of options available to you. USCIS is terminating deportation in many cases where there is a US citizen spouse. Your lawyer should contact the Government attorneys and negotiate a possible termination.

Asylum claims need to be made within one year of arrival, unless compelling reasons prohibited you from filing. Find a co-sponsor that will be your best bet.
