Yes. You can marry anyone you want. Marrying some one in jail, you will need special permission or your fianc may bond out of immigration custody and you may get married afterwards. If you need assistance regarding your fiance's immigration issue, I suggest you get and consult an attorney.

Of course, you can. You can marry any person of your choice. I guess that is not your issue. However, if you are trying to find out whether marriage may prevent him/her from being deported from this country, an investigation must be conducted first.

You will the permission of the deportation or removal officer in order to get married. You can obtain the license. If the immigrant entered the US legally but overstayed the permitted time to remain in the US, then once you marry, you can file a petition on the person's behalf, and depending on what charges immigration has filed, you may be able to get bond, and the person released.

You can marry him any time. The question is whether it will help him to remain in the U.S. He could be able to stay if you are a US citizen, he entered the country legally and is otherwise admissible. I strongly recommend that you see an experienced immigration attorney before you tie the knot.
