QUESTION

Can I marry her when I’m on a B2 visa?

Asked on Jul 10th, 2014 on Immigration - Michigan
More details to this question:
I am b2 visa holder and currently in the US. I came in the US in April 14 for the first time to meet my family and relatives. I met a US citizen girl in a family get-together. We were attracted to each other and start dating each other. In July 14, we wanted to get married with the blessings of family members. What should I do after marriage and am I eligible to be an LPR? What forms I should file?

Yes, marriage to a US citizen is possible while on a B-2. Thereafter, you will need to file an adjustment of status to Lawful Permanent Resident.

First, congratulations on finding a person you want to spend your life with. Yes, you can get married. As far as eligibility for legal permanent resident status, I'd love more information. Many attorneys, my included, would offer a free consultation. That's the route I would take, so that you can get a better understanding of the process and requirements.

Yes, after you are married, you can adjust to a conditional (two-year) LPR status. You need to file forms I-130 and I-485. Also include forms I-131 and I765. Read all the instructions carefully because all these forms require additional forms (I-864 and G-325A) and many documents.

You can apply for adjustment of status on the basis of marriage once you are lawfully married but it may look a bit suspicious that you were able to meet, fall in love with and decide to get married and actually get married to someone you never knew before, all within 90 days.

A person here on a B-2 visitor visa can marry a USA citizen and then file for a green card while they are here. There are lots of forms and documents required but ultimately it can be done.
