QUESTION

Can I petition my step father?

Asked on Oct 14th, 2011 on Immigration - Texas
More details to this question:
My step dad and my mom have been together ever since I was young. And I have brothers and sisters. I want to help my step father to get here, as well as my brothers and sisters. I'm wondering if this is possible. Can I appeal and I'm wondering what kind of information that the judge will require besides the marriage certificates? I do have half brothers and sisters that are closer to my age and I'm wondering if I can use this as proof instead of marriage?

If you are a US citizen over 21 and your mother married your stepfather before you turned 18, yes. Half brothers and sisters are considered your siblings and you may file petitions for them as well.

If they were married before you were 18, you can petitin him. If they were never married but you can demonstrate he lived with you and essentially had active control this can sometimes be seen as adoption but is very difficult. See a competent immigration attorney to fully evaluate your case.

Your mother should petition her husband if she has legal status. You cannot petition your step father unless you have been adopted by him. See an immigration lawyer for help.
