Can I petition them jointly or does she have to wait until he is a resident?

More details to this question:
I am a citizen and would like to petition my father, stepmother and their 2 minor children (4 years and 9 years old). They married when I was 19 years old. Also they hold Venezuelan passports but currently live in Chile (with work permits etc.). When I petition, what is best? A. Petition while they are in Chile. Would they have to go to Venezuela to get passport stamped or in Chile? B. Have they come as tourists and once here introduce the petitions? What would be faster? My step mother works for the U.N. in Chile and it would not be a good idea to go to Venezuela right now or any time soon. They have been married over 16 years.

You can only petition for your father. Since he married your stepfather after you turned 18, you cannot petition for your stepmother. She would need to be petitioned, along with the kids, once your father gets his green card.

Parent and child relationships must be legally established before a child's 18 birthday. US citizens who are at least 21 years of age can petition for their parents and siblings separately. They cannot be included on the same petition.

You will need to petition parents separately. The children cannot come with them on your petition. You need to speak with an attorney about your options.
