QUESTION

Can I stay for extra one week after my visa expires?

Asked on Feb 09th, 2014 on Immigration - California
More details to this question:
I came into the US for vacation on a B1/B2 visitorโ€™s visa on the 6th of February 2014. Initially, I intended spending one month to return back to Nigeria on the 5th of March 2014. My 2 year visitorโ€™s visa is expiring 8th of March 2014. At the entry point, my passport was stamped to leave on the 5th of August 2014. I need an extra week in the US, which means I will be leaving 12th of March 2013 but my visa is expiring 8th of March 2014. Please kindly explain to me so that it won't affect my renewal. Thank you.

The expiration date of your visa is the last date you could have entered the U.S. on that visa. The length of time you can stay in the U.S. is determined by the admission stamp in your passport. If the admission stamp says that you can stay until August 5th, you can stay until August 5th, regardless of the expiration date of your visa.

You need to check your I-94 card to see what the expiration date is. If your plans include leaving before that date you are fine. You can print the I-94 card out here: https://i94.cbp.dhs.gov/I94/request.html;jsessionid=TqG3R7NGdWhGJyrGQMW9 nvD4gBmKQWVCnR59nh2GFbTslZSXJKpQ!-2069423574
