QUESTION

Can I still file a petition for my mother even if I stop working?

Asked on May 14th, 2025 on Immigration - California
More details to this question:
My situation is that I have already filed Form I-130 to petition for my mom to come to the U.S., and I am currently waiting for the case to be approved. What I’m wondering is whether it would be denied if I stop working at my current job to pursue my nursing career, which may result in insufficient income to support my mom.

If mom is overseas, and you have a pending I 130 immediate relative petition, you will be required at some point to upload an 864 affidavit of support to prove that you financially can sponsor your mom. If you have lost your job, then you should retain a joint sponsor who does have the financial ability to sponsor mom.
