QUESTION

Can I visit while the immigration is in process?

Asked on Oct 25th, 2013 on Immigration - Texas
More details to this question:
My f2a is in process and the forms ds-230 and ds-260 have been filled. I have already got the email that my interview will be scheduled soon. I have a visit visa and have visited twice before while immigration in process, but haven't since I have submitted ds-230 and ds-260. I don't intend to do any adjustment status but want to visit till I get the interview date. Can i visit now, other than the entry problem, will it have any impact on my immigration?

You will probably not be admitted to the US as a visitor since you have immigrant intent and the consular process is ongoing.

Generally, there is no law prohibiting you from visiting while you wait for the completion of the consular processing.

Most likely a visit at this time would be denied, as you would have a very difficult time showing non-immigrant intent. Even with a return ticket, the presumption would be made that you have immigrant intent and would not be admitted as a visitor.

I am not sure if I would risk it.

Don't do it. Once your immigrant visa application is filed and pending, your proposed visit to the US may cause you problems including possibly being refused entry and deportation.
