Can my brother remain in US with no current documents?

More details to this question:
It has been 10 years since my brother’s I130 for was approved. What I would like to know is my brother still legal to remain in the US as his I130 is still waiting for processing? My brother has no current passport or visa. He cannot work and has just been living with me for the entire time here. Should I file for I-485? Would he get approval for a green card to work here with this or is waiting for a permanent residence card the same? My brother is 37 years old.

Your brother can only adjust status if he is currently in status. Your brother should discuss his case in private with a lawyer .
