Can my husband's past due child support affect my ability to gain permanent residency?

Asked on Mar 30th, 2013 on Immigration - Michigan
More details to this question:
My husband has a pending past due child support from his former girlfriend in Michigan and we're about to apply for the removal of my conditions in permanent residence as my green card will expire on August 28, 2013. He has been unemployed since 2010 while I on the other hand am employed. How will this affect my application?

It should not affect it in any way. The USCIS is only going to be looking at the bona fide nature of your marriage.

For an I-751, it should not be an issue, generally speaking.

Your husband's past due child support and employment history is not a conclusive factor in deciding your I-751 petition. USCIS is more concerned with documentation to prove that you and your husband were married in good faith and still share cohabitation.

There should be no effect in having your conditions removed if you are still in a valid marriage.
