QUESTION

Can my spouse file an I-130 while I'm on a J1?

Asked on Mar 30th, 2017 on Immigration - New York
More details to this question:
I will have a J1 visa for June to September. If my spouse files an I-130 in July to start the process, can I remain on the J1 visa until September without having to apply for AOS, on the understanding that I will definitely be leaving the US and returning home in September (before the expiry date of my J1) for a family holiday? Or, if we file in July, will I also have to apply for AOS in July and will I have to stay in the US until a decision has been made on the I-130?

You will be in J status until it is valid and until AOS is granted.
