Asked on Jul 01st, 2014 on Immigration - Texas
More details to this question:
My stepmother sponsored me for a U.S. immigrant visa and recently got approved. But she and my father had a fight and now she is not going to file an affidavit of support nor pay for my visa processing fee. I am aging out soon what will happen to me? Is it possible that my father replace her as my sponsor? (He recently got his permanent resident card after 3 years of marriage).

If your father sponsors you, it could take several years and you could age out. Ask her to reconsider or consult with an attorney about the CSPA.

Until you actually arrive in US with the immigrant visa, your stepmother petitioner can cancel the petition she filed for you even if it has been approved. Apart from trying to persuade her otherwise, there is not much else you can do because under the law, the petitioner has the right to withdraw from the petition. Your father must immediately file a Form I-130 petition for you. If approved, you can come to the US based on his petition.

That could be a HUGE problem. Hopefully they make up and you get your visa or status. In the worst case, your dad could start over for you, but due t the quota, it could be a very long process.
