My mother came illegally to the US in 1989. then my US Citizen sister applied for her and she went to the appointment to Cd Juarez, there they told her she did not qualify because she had no dependents (US Citizens) under the age of 18 or married to a us legal resident or citizen. She was also accused of human trafficking because she had two of my siblings when she crossed the border. She was given the 10 year bar and she has been in Mexico for about 3 years. She has 8 children (and many grandchildren) and all of us are here in the US. Two are US Citizens, four are permanent residents, one has the dream act status, and the last one has no legal status. My mother is lonely in Mexico and she is 62 years old with diabetes and other ailments. what can we legally do to bring her to the USA?
Your mother’s child who is a US citizen can petition for your mother to come back to the United States. After her interview, she will be found inadmissible because of the 10 year bar and she should then be able to apply for a waiver to re-enter the US. Waivers can be extremely difficult and hard to win. I would recommend having an attorney help with the application process.
