Can we submit an I-212 prior to 10 year date?

More details to this question:
My husband was just advised at the consulate interview he has to wait until January 2021 to apply with the I-212 (he was removed under voluntary departure January 2011 and has been in Mexico since). The immigration judge told us at the hearing if he leaves the country prior to the date set he would not have the 5-10 year bar, but the consulate gave him a bar anyway. I-601 was approved but they still denied him entry.

Hello, You did not provide any information about the reason why the consulate denied him entry if his I-601 application was approved. Why was he deported? Did he have a criminal conviction and if so, what type?
