Converting from H1 to H4 and back to H1

More details to this question:
I came to United States on F1 . Graduated and working under H1 . Due to personal reasons . I am planning to change to H4 Visa for about 1 year . Probably move back to H1 after that . I am planning to go India for H4 stamping . currently I don't have H1 stamping just H1 approval receipt Question Will there be a issue later when I move from H4 to H1 - Since I don't have a H1 stamping ( change of status H4 to H1 ) Do I need to apply as a new H1 or I will be under cap exempt How easy to change from H4 to H1 - Processing time - Can I do premium for this

H-1 stamping is not a sine qua non for a change of status from H-4 to H-1B. A visa is mainly for travel to and from the United States during the time that an individual is holding that status. Your later application will be a new H1B petition, but you should be cap exempt. As long as you are maintaining H-4 status and the new H-1B position and your qualifications match and the job is in a specialty occupation, you should be able to change from H-4 to H-1B. Current processing time is anywhere from 3-6 months. You can ask for premium processing.
