Currently on H4 visa and applied for H1b visa and traveling to India, Traveling on 1st april and returning on 7th May. I want to know if there is a risk in this travel plan because my I94 will change when i come back to US, my second question is if its emergency and I have to travel then what can we do later to avoid risk on H1b.
Since you currently have an H-4 visa and are returning on May 7, you should not have a risk in returning to the States even if you are applying for an H-1B visa. When you have an approved H-1B petition, you would have to interview at a U. S. consulate or embassy in order to return with the proper visa.
