We are eligible for dapa.my fiance has a greencard application from 95.I130 was approved.we have three citizen kids.he had one incident were he got arrested.he had a shotgun.lots of charges but they were ALL withdrawn/dropped.no charges at all.will he still be eligible for any of this?he was charged but never convicted.
For a person to be excludable under U. S. law based on crime, there must either be a conviction or the admission of excludable acts. Unless your husband admits to the charges, he would not be excludable and would remain eligible for a green card and DAPA.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
