QUESTION

Deportation proceedings

Asked on Jun 28th, 2016 on Immigration - Massachusetts
More details to this question:
For over two years my husband has gone to many hearings, just for the lawyer to keep asking for more time. First she asked him to get letters pay his taxes etc. she was to build a case on that. When she found out she got married she completely dropped everything and ask the judge for another hearing. Since then my husband has a knew hearing. Just a few months later. She claims these hearings will keep happening until the marriage process is over. This news hearing she claims is for change of address so my husband has to drive all the way to Virginia to tell them he changed his address. She said this will happen every couple of months for a few years. Each time he had to pay her 500.00. He already paid her a lump sum to take on the case.

More information is needed to make a complete assessment. However, there are some things that are concerning. I am not clear why your husband's attorney has not sought a change of venue if your husband does not live in Virginia. Immigration courts will typically change venue unless testimony has been taken. The second issue is why not either seek administrative closure why the marriage case is pending or request an adjournment prior to the hearing if your marriage petition is still being adjudicated. There may be valid answers to these questions. A review of the file is necessary to make any definitive assessment. Ask the attorney for a copy of the file. You can take the copy to an attorney for a second opinion.
