QUESTION

Divorce before 2 year conditional resident card expires

Asked on Jan 23rd, 2014 on Immigration - California
More details to this question:
I have a question about divorcing before you two year conditional resident card expires. We've been married for over two years, my card expires is less than 6 months but we haven't been living together for about 6 months because he had an affair...so I moved out and signed another lease so I'm kinda stuck with my apartment... and also it kinda looks like we might not reconcile and we are looking into a dissolution divorce... I know I can file if I have the divorce degree but how dangerous and how likely is it that I could do it on my own? What are my options? :/

Hello.  You can file the application without him. You will need to provide lots of proof of the bona fide relationship from the beginning until you were separated. You must be divorced to be approved on your own. Thus, you should start the divorce and file near the 6 months. This will give your divorce time to finalize. You will also get a new interview by yourself where they will ask about your relationship, history, etc. Please let me know if you would like any assistance. Harun@kvisalaw.com 858-874-0711.
