QUESTION

Do I have a chance to get a green card through asylum?

More details to this question:
Hi, I've been in the U.S. for a month now, on a B2 non-immigrant visa. I was granted 6 months of legal stay. I have 5 months left. I'd like to become a permanent resident of the United States through (refugee\asylum). I am from Yemen, and Yemen is an unstable country, filled with extremists. I am a gay person, and in Islam, gays should be executed if I may say, so this proves that I am personally in danger, so I finally was able to leave Yemen. Is there a chance for me to get a green card through asylum? Personal information: 19 years old. Both parents are not U.S. citizens. Unmarried. Unemployed because I need an employment authorization. Thank you.

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. The short answer is that it is possible. However, be aware that you must file your asylum application within one year of entering the U.S. or else you will be time barred. I strongly suggest that you contact an experienced immigration/ attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. (S)he would then be in a better position to analyze your case, advise you of your options and, if possible, make sure that the necessary paperwork and documentation is presented so as not to delay the process.

A person can eventually get a green card after being granted asylum. As for a work permit, they can apply for a work permit after the asylum is pending for 150 days.
