Do I have any options to adjust my status?

More details to this question:
I over stayed my visa because my step dad was supposed to file for me but it turns out he can't since I turned 18 two months before they got married. I have a baby that was born in the US but I'm not with my child's father. Is there anyway I can obtain my green card? My mom has her green card.

If you marry a United States citizen, you can adjust status without leaving the U.S.

Your Mom can petition for you but it would be many years before you actually got a green card. There may be other options but I would need to talk with you about the specifics of your case.

Your mother may file an I-130 for you, but that will not result in an immediately available visa. All the same, it would be best if she filed the I-130 now. Your child cannot file for you until they child is 21. You may have some options, depending upon additional information.

A bona fide marriage to a U.S. citizen would allow you to adjust if you entered the U.S. lawfully.

Only through a marriage to a US citizen. Otherwise, you would have to wait for your child to turn 21 in order to get a green card.

Your mother needs to become a citizen as soon as possible and petition for you. Hopefully this occurs before you turn 21. Speak with and retain an immigration attorney to make sure there are no mistakes and everything is taken care of as soon as possible.
