Do I need pay stub to file I-130 form?

Hello Sir/madam, I recently got married with my husband in Pakistan on the 02 of December 2011. And finally I am becoming citizen next month and I was just wondering if I need pay stubs with tax returns or not, as far as I know tax return paper shows every thing? Can you help me file petition I-130, along with immigration visa for my husband. He is in Pakistan right from birth. Please reply as soon as possible, I will be grateful to you. Thank you.

You do not need a pay stub or tax returns to file the I-130, but once that is approved, and the immigrant visa application process begins, you will definitely need to file an affidavit of support and attach to it the most recent 3 years of federal tax returns with W'2, and a recent pay stub, showing current employment. If you do not make enough money based on the Federal guidelines, you will need a co-sponsor. I can definitely help you complete the entire process from A-Z.

I do not believe a pay stub is necessary to file an I-130 petition. For the most part, an I-130 petition requires evidence of the bona fides of your marriage, and I do not find that a pay stub is relevant in that context. However, if and when you file for his immigrant visa, the NVC may need assurances with respect to your ability to ensure he will not become a public charge. As a result, your pay stub, tax returns, job letters and the like may then be necessary for you to undertake the obligations contained in the Form I-864 Affidavit of Support. You need to hire a qualified immigration attorney to assist you in filing your immigration paperwork.

You will need to file several forms. I-130 is one of them. Then, you would need to support him to bring him here. Either you are working, or you should find a co-sponsor. You will need certain documentation besides just tax returns. You can also bring your husband in on a fiance visa right away and then deal with your petition here, while he is here legally. There are many ways you could do it and the best way is to do it with an immigration attorney who will evaluate your situation and proceed ion a most efficient way. It should not cost you much, but the petitions themselves carry government fees.
