Do I need to file a separate form to include my son in the immigration petition?

More details to this question:
I am getting ready to petition for my wife who lives in the Dominican Republic. My wife has a son from a previous relationship. He is 3 years old. Do I need to file a separate form to include him in the petition and pay a separate fee?

A separate consular processing application and separate fee will be necessary for the child. Consular processing can be deceptively more complicated than the forms appear, and if you are unfamiliar with the steps to be taken it would be wise to engage an immigration attorney to assure proper steps are taken and long delays (or even worse consequences) avoided.

You will need to file a separate petition for your step son.

If you are a USC, then you file two petitions. If you are a green card holder, then you can include the minor child on your wife's petition.
