The father of my 3 children has I-130 approved in 2005. We have spent a lot of money with attorneys and no success. They haven't done anything further they tell us he has a good chance but that's all. His TPS was denied in 2011 due to the misdemeanors. So he hasn't renewed it since. He has 3 misdemeanors the oldest being in 2010. We have all the records court dispositions, etc and wanted to know if we can file everything ourselves?
There is no law or regulation requiring an applicant to be represented by an attorney in the immigration application process. Then, again, there is no law requiring a patient to have a medical doctor in order to remove his appendix. Your question does not provide sufficient details to understand all of the issues that led a lawyer to conclude that the father of your children "has a good chance" with an immigration-related application. Nonetheless, it sounds like his situation is far from ordinary, and may be particularly complex and challenging. An application without legal eligibility, or an inadequately prepared or insufficiently documented application can result in substantial delays or even more harsh consequences. The decision of the father of your children about working with an immigration lawyer will depend upon how important it may be for him to succeed with an immigration application.
