QUESTION

Does filing an incorrect tax form affect my greencard application?

Asked on Aug 04th, 2011 on Immigration - California
More details to this question:
I am currently in a F1 visa.. I got married to a US citizen and going to submit an application for greencard... My question is - I filled incorrect tax form 1040EZ instead of 1040NR-EZ during the last 3 years.. I was wondering should whether i should amend these changes before submitting the greencard application or I can do it later...(I am planning to do for sure.. but right now I am overwhelmed with enough paperwork, I dont want to overload with new tax papers)

You should contact a tax advisor. If tax violations result in criminal charges, it will affect your immigration matter at this time.

Your tax returns are not required for your permanent residency only your wife's. Your taxes can be corrected fairly simply by a qualified accountant or tax attorney.

You can submit your package as is, as long as the correct figures are on the I-864 Affidavit of Support form. Then, the government will provide you with a Request for Further Evidence if they need 1040 federal income tax forms.
