More details to this question:
Hi, my nationality is portuguese but I've got over 15 years living in Spain, with lawful residence permit and a property. Can I apply for a E2 visa? I'm looking to become self-employed in the US. Portugal is not a treaty country but Spain is. Thank you.

Unfortunately treaty investor visas (E-2) depend upon the person having a passport of the treaty country. Having permanent residence and a property in Spain is not the same and does not qualify you to be considered an E-2 alien of Spain.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
