Hi, I am a (born in UK, citizen of Australia) married 42 yr old diploma qualified computer programmer I am also qualified as an electrical engineer/technician, my wife is a 32 yr old primary teacher kindy through yr8. I would LOVE to live in the states, culturally I believe we would be a great fit. Unfortunately we are not rich i do not have a million US on invest I am only worth about 300k :(. To me we seem like ideal candidates yet it appears no chance at all....yet......I see so many unskilled migrants flooding into the US e.g. taxi drivers, food vendors etc. from Asia, Middle East and Africa. I do not understand, I even know of people who have lied to get a green card, worked with brother in Australia. Please tell me what the deal is we would be great citizens yet the US does not want us, yet it appears to take the questionable populace from other areas?
An initial question would be whether you or your wife are able to receive job offers in your respective fields. If you are able to do so, and if you both have the equivalent of US baccalaureate degrees either through equivalent degrees or a combination of education and working experience, you may be able to obtain working visas under the E-3 visa for Australians. You can also at a later point be sponsored for permanent residence through the labor certification process which would depend upon the wishes of your employer. If you do not have a job offer from a US employer, you may be able to establish your own business in the US and live here for many years through an E-2 investor visa which, while not a permanent resident visa, is a long term one under which you would be allowed to continually work in your own investment.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
