I am an American citizen and I have lived abroad most of my life abroad. I have a girlfriend of 8 years who lives abroad. She has a tourist visa to the US. Is it advisable to marry her on her tourist visa in the US (she doesn't plan on staying immediately as she has a job, however I want to process her paperwork and get her here permanently after her visit? Is there any legal issue with this scenario?
Once you are married, She can apply for a spousal visa (as opposed to a fiancé visa) at the US consulate overseas. That process takes longer than a fiancé visa, more than a year but less than 2 years and is less expensive as far as processing fees paid to Uncle Sam. If she gets married on a tourist visa and then remains here that would technically be considered immigration fraud. Why? Because she obtained a temporary B visa but her concealed intent was to remain permanently. Consider working with an attorney so that the case is processed correctly.
