More details to this question:
The question surrounds a franchisee that is owner/operated itโ€™s a pool servicing franchisee does this qualify for the E2 visa. Does the growth of the business need to be reflected in the business plan, to show its growth and development that leads to the hiring of US personnel. Does the business need to have an employee from initial purchase or can it reflect in the business plan as a future function of the business to expand and hire. Thanks.

For you to fully prepare an E-2 case, and to answer your question completely, you really need to work with a competent immigration attorney in your area. As a general matter, if you are coming to develop and direct an entity; meet the % ownership requirements; invest your funds correctly; and are going to hire numerous US workers within a reasonable time frame, then this can be sufficient for an initial E2. You definitely must document market research, fiscal and employee projections.

A franchisee can seek an E2 visa if they are from a country with an E2 treaty with the US. The investment should be close to $100,000 and require the employment of at least one American.
