Friend allowed to stay in USA while his K1 visa is processed?

More details to this question:
My friend thinks he is allowed to stay while his K1 visa is being processed. He and his fiance hired a lawyer to do their paperwork and his lawyer said he could go back or he could stay, but he wasn't allowed to work. From what I gather the lawyer stated "I am telling you you can stay." and said something about the cover of law? I am in a simular situation and having my fiance here during the process would actually benefit my mental, psychical, and financial health. He is currently in Texas so I don't know if this is just a Texas thing or a USA thing.

fiancée visas are issued overseas at the US consulate. A US citizen can sponsor his fiancée for a K visa, and once the visa is issued, the foreign national will travel to the United States but must get married within 90 days, after which that for national could be sponsored for a green card.
