QUESTION

Green card for parent banned for 10 years

Asked on Dec 20th, 2018 on Immigration - Georgia
More details to this question:
Hi, My dad was banned from the USA for overstaying his Visa. He was in his home country and tried to renew his Visa to come back to visit, but couldn't because he overstayed he old Visa and was given a 10 year ban, which ended in 2016. I am an American citizen and I'm in a position in which I can sponsor his green card. I was wondering if we MUST hire a lawyer to handle his case, or if he could fill a special form with the American consulate in his city before we start his green card process.

I would strongly advise you to retain counsel. Whenever there is an Immigration ten year ban, there is wide discretion for the Immigration officer handling your case to rule negatively on any immediate relative petition. You should discuss your case in private with counsel. Many of us give free consultations and counsel anywhere in the US can represent you per Federal law.
