Green Card Processing for Divorced Sibling

Hi Experts, I am USA citizen residing in Virginia. I am planning to file the Green Card for my parents who are residing in INDIA. I was told, by someone, that my parents will get the Green Card soon, may be in 6-9 months. I have my younger brother and he in USA on H1b. He is going through a divorce and hopefully everything will get settled soon and he will come out of the divorce. My question here is, can I file his Green Card as well along with my parents? If yes, is there any way that his Green Card can also be processed in the same way as for my parents. I will appreciate the answers. Regards, Sumit Sharma.

Yes, you can file for him, but his greencard will take about 18 to 20 years and he cannot be here out of status awaiting it. Your parents may petition for him once they are greencard holders, again it's about 8 years. For your brother I would recommend and urge him to consult with and hire an immigration lawyer to assist him with his case. The lawyer  will be able to debrief and brief him, analyze, assess and evaluate his case in order to maximize the possibilities for an alternative and successful result.
