My H1 I-797 expired in Oct '16 but my I-94 is valid till June '17. My employer filed a timely H1 extension in Sep '16 and I have completed 3 years on H1. My project is ending unexpectedly in Nov '16 end and my employer has informed me that because of financial issues they most probably will end my employment by Nov '16 so I should look for options. I am trying to convince my current employer to file for premium processing before the termination but I've also found another employer who is willing to transfer my H1. Is it allowed to file for H1 transfer while current h1 is in extension with expired I797 but valid I94?

It is not advisable to seek an H-1B transfer while an extension is pending. It would be best to seek premium processing of the extension before seeking a transfer.
