Asked on Jan 12th, 2016 on Immigration - Kansas
More details to this question:
I am currently on H4. I have found a consultancy who is ready to sponsor for my h1b . If by any means I want to quit my job after my visa is stamped , what will be my visa status? 1. Will it get converted to h4 or do I have to apply to USCIS for changing my status back to h4? 2. How long will be my h1 be valid till I find another employer? 3. If my status changes to h4 , do I have to file a fresh new petition to get h1 and will the visa cap hold good for me? Thanks for your help in advance.

1. Your status does not automatically revert back to H-4. You would need to either file a change of status before terminating your employment or depart the United Stares and re-enter with a valid H-4 visa. 2. There is no grace period if your employment is terminated. Your status automatically terminated upon termination of employment. 3. You would need a new H-1B petition. You would be cap exempt assuming your prior employer was cap exempt.
