QUESTION

H1B expiring - I-140 pending, what to do?

Asked on Jan 02nd, 2013 on Immigration - California
More details to this question:
My current H1B visa will expire in June 13, 2013, my current employment authorization card expires on January 13, 2013. I submitted my I-140/485 application on Nov 2011 and got a RFE notice in Sept 2012 which I responded on Oct 29, 2012, my question is what should I do now: 1. Request a H1B extension for other 3 years, my current employer agreed to do so. 2. Request an extension for my work permit and wait? I checked the status of my case at the USCIS website and the Nebraska Service Center processing time average is 5.6 months, it does mean that I should wait other 4 months to know if I will be granted a green card?

I would strongly suggest a H-1B extension, if you have time. Please let me know if you have any additional questions or how I can be of further assistance to you in this matter.

Hello: You should apply for an extension, but more importantly, you should seek professional help on responding to the RFE.
