QUESTION

H1B Extension after after DUI - 2016

Asked on May 31st, 2016 on Immigration - Michigan
More details to this question:
I was arrested on Feb 2016 for OWI which later was reduced to OWVI and I have paid fines and currently under restricted driving for 3 months (2 more months to go). There is no probation. My employer is about to file for my H1B extension sometime in this month which is expiring on Jul 2016. It seems there has been recent change in policy and I got below link from my employer https://travel.state.gov/content/dam/visas/AILA/Agenda%20Spring%202016%20Qs%2BAs.pdf Reading point 6, 7 and 8, I am not able to figure out if the extension will happen or not. Here are the questions 1. Will I be still eligible for an extension? If yes, what are the documents I shall get from court. So far I have none since the sentencing was done 2. Also how do I provide these documents? Via my employer? Please help!

1. Your employer's extension will likely be approved. The issue is that your underlying visa (the document that lets you enter the United States) could be revoked. You could also have difficulty renewing your visa in the future.  2. You should only submit the documentation if requested.  You our should be working with an attorney.
