I used to work as a consultant in a software firm on my L2 visa with EAD. This year my agency submitted my petition for H1-B and started processing. In the second week of september USCIS sent a mail requesting for evidence (RFE) for which my agency responded atleast 2 weeks later. In the second week of october i spoke to my agency and they said they have submitted all the documents and also expedited the processing to premium. Since then I regularly check the USCIS website but see the same status it used to be saying a mail has been sent requesting more documents. When I call my agency they keep telling me that they are talking to the attorneys and will give me an update soon .That never happened till the time I am typing this. So i have a lot of questions here now. 1. In my case what can i ask my agency as a proof that the documents have been submitted and the process has been expedited? 2. If the process has been expedited what would be the maximum processing time for H1-B?
The maximum period to obtain a response when premium processing is requested is 15 calendar days. If the agency sent in the premium processing fee, you should already have received a decision. If you wish, you can ask your agency to give you a copy of the I-797 receipt which is given by U.S.C.I.S. when a premium processing application has been made. The fee amount should be $1225 on the receipt.
