QUESTION

How can a permanent resident bring his girlfriend to the US?

Asked on Mar 26th, 2012 on Immigration - New York
More details to this question:
I have lived in the USA for a year and four months and is waiting for my Green Card now. But I have left someone I love in Russia and we want to be together but I don't want to come back to Russia. As far as I know, I can request fiance's visa only when I will become a US citizen. But is there anything I can do now so we could be together? Thank you.

I would recommend you look at various nonimmigrant options for your girl friend depending on her education and work experience.

On what basis if your green card petition pending? Is it employment based? If you do not yet have the green card, you can get married to your girlfriend and have her file for the green card as your dependent and she will be able to get it along with you. But this is only if it is through employment and the I-485 is not yet approved.

Permanent resident cannot file for K-1 visa. If you marry him and if you are LPR, you may file I-130 but it may take 2-3 years.

If your green card application has not been adjudicated yet, your girl friend may be eligible to apply with you if you marry before a final decision is made. She would otherwise have to qualify for visa in her own right.

If you have your green card and are married you can petition for your spouse but it takes about 2-3 years. Otherwise there is not anything you can do until you are a citizen.
