I came to the USA from the UK in 2009 on a visa waiver. My husband is a united states citizen. He was in the Navy for 8 years and was in when we met. I had been talking to him for 8 months prior before I came to visit him with my visa waiver. We got married shortly after however it wasn't planned and I have been here illegally for almost 7 years. We have tried to get the paperwork sorted many times but have always gotten into financial issues that stopped us from being able to complete it because he was the only one that was working and was on a low income at the time and still is now. I want to be able to help support my family and find work and I havent been able to get my adjustment of status done and im worried that I will not be approved for it or sent back to the uk. Is there anything my husband can do on my behalf? Can i still apply for adjustment of status and how long will it take for me to apply for citizenship after i have adjusted my status to being a perminant resident.
You should still be able to apply for your green card through your husband. After holding your green card for three years, you would be eligible for citizenship. If you are deported from the US or you leave the US on your own, it will be very difficult for you to come back to the US. You should get the paperwork filed right away to protect yourself from deportation.
