QUESTION

how can i be with my children again

Asked on Aug 22nd, 2013 on Immigration - Massachusetts
More details to this question:
My children are US citizens aged 11 and 6 years old. Previously I brought them to my country because my asylum case was disapprove and i was ordered voluntary departure while my husband who is Chinese citizen staying there with a working permit. Recently my daughters back to US to study, I wanted to accompany them but my visa application was refused because they think I won't go back to my country Indonesia, since my husband and kids in the US. I want to be with my children, they are stilll too young to live without a mother and my husband have to work a lot, and it will be very hard for him to work and taking care of the kids because they are still not independent yet. I want them to grow and have a good future and personality. I just very worry that they have to live and grow alone without guidance and support of a mothert.

If your visa application was refused for immigrant intent there is not much you can do other than perhaps strength the ties you have to Indonesia and reapply later with stronger proof that you will return.  Still having family in the US will make it very difficult for you to overcome that presumption of immigrant intent that otherwise will cause a denial.
