Asked on Aug 18th, 2011 on Immigration - Texas
More details to this question:
My wife is a US citizen and she wanted to bring her mom to US. But the problem on my wife birth certificate is. Her mom used his first husband last name instead of using her maiden name and when she was trying to get a record of her marriage certificate the NSO said that there is no record of marriage and they donโ€™t want to issue a passport to her because she canโ€™t show any marriage certificate she can only get a passport under her single name. Can you please help or tell us what last name we should put on I-130 is it the one on my wife birth certificate or the on her mom birth certificate?

Your case is a bit complicated and I suggest that you hire an immigration attorney. They may have to do DNA tests to prove relationship.

If her passport is incorrect she should get this corrected so her official documents match each other and then use that name. It sometimes takes time to get the correction but that is the best way to proceed. Sounds like she needs to start by getting the marriage certificate documentation for that to be issued correctly.
