QUESTION

How can I clear my name from false allegations?

Asked on Oct 27th, 2012 on Immigration - Texas
More details to this question:
I have been a resident alien since I was age five. I am now 43. I wanted to file to become a US Citizen but had legal issues. My now ex-husband made false allegations had me arrested. There was also a typographical error on that charge stating I abused a corpse! I learned this when I travelled to visit Canada. I desperately want to be a US citizen. Thank You.

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. I strongly suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case and advise you of your options.

You will need to contact an attorney and have your record reviewed to determine what will need to be done, and if you will qualify for naturalization.

A mere charge is not enough. A conviction can have consequences. Interesting charge but did the criminal court make this charge or was it part of the divorce. The federal authorities will not be influenced by a disgruntled spouse's allegations in a civil proceeding unless it raises an issue of fraud.
