My daughter was born on Mexico and I’m a United States citizen. How can I file for my daughter’s citizenship?

If you were a US citizen at the time she was born and you had registered her with the US Embassy in Mexico, you can get a US passport for her. Otherwise, you will either need to establish that the child derived US citizenship at birth or petition on behalf of the child now.

If you have been a citizen for 5 years before her birth and meet certain other requirements, your daughter is a citizen also. Consult with an attorney.

You must first file an I-130 visa petition with supporting documents. Once approved the file will go to the National Visa Center and they will provide further instructions.
