You must be lawfully present in the United States at the time that you are petitioned. Otherwise, you may be denied a visa petition and revert to immigration court for deportation. If you entered with a visitor visa, but your 90 or 180 day stay expired, then you are in overstay and rarely fix your papers through a business based visa.* I strongly recommend an appointment with a competent and experienced immigration attorney before there are further complications.*
