How can I fix papers for my fiance?

More details to this question:
I am a US citizen and live in California. My fiance and I are planning on getting married this summer but I don't know if I can apply for his papers as we get married or do I have to wait until we are legally married. He has a visiting visa and we are planning to have a future together but we don't want to problems with the law. I was also wondering would the process take months or years?

The process for a fiance visa takes about 10-12 months so if you plan to get married in the US in the summer, it will not be enough time for the fiance visa. However, if your fiance is already in the US lawfully by the time of the wedding, then you can just apply for the green card on the basis of marriage after that.

The process should take 10-18 months at the most if everything goes well. If you are a Citizen petitioner , upon marriage the petition can be filed.

He can visit and marry and apply for his green card. Just don't apply too early. I recommendation is to wait a couple of months after your last entry before getting married. He will be questioned about his intention upon his last entry. He should consult with an experienced immigration lawyer prior to filing.

More information is needed. The process can take years if he departs the United States. There is a way for him to remain in United States so that he can be with you during the entire process.
