How can I get a visa after being deined twice under 214(b) and I have a public intoxication charge? Hi, I was recently charged with two counts of theft by taking in october but they were dismissed on the grounds that I take a nolo plea to public intoxication. I recently went to go renew my student visa and was denied twice on the grounds of 214(b). Ive shown country ties outside the US and showed I intend to return after studies so I have a feeling they denied me due to the charge. How could I work around that? I have an appointment coming up.
US consuls have great discretion in the issuance of nonimmigrant F-1 student visas which require a showing of nonimmigrant intent. I suggest that for the interview you should bring whatever documents that you can think of to further show bonds with your home country. Perhaps such items as a list of all your immediate family and where they reside, offer of a future job, statements by others is to why they are certain that you will return to the home country after your studies, etc., would help.
